Overview of Michigan's Super Drunk OWI Law
The Michigan legislature enacted its super drunk law to punish those found operating their vehicles with excessive blood alcohol levels (BAC). If you are convicted of this offense, your penalties will be increased over a regular OWI. You will lose your driver's license and will walk away with a permanent criminal record. This law applies to first-time offenders or those who have not had a prior OWI within the last seven years. If your BAC measures 0.17% or higher on a chemical test, you will be charged with this offense. A conviction is punishable by:
- Up to 180 days in jail
- Up to a $700 fine
- Up to 360 hours of community service
- Up to one year of a license suspension
- Mandatory attendance and completion of an alcohol treatment program
- Six points on your driving record
- Installation of an ignition interlock device (IID)
A restricted license allows only limited driving privileges and only with the use of an IID. Under the Driver Responsibility Act, you will also be subject to a $1,000 penalty for two consecutive years.
